Booking Conditions
All bookings are made with Tour With Me (we, our, us, Tour With Me, or TWM), which trades under its parent company Aweventurer Pty Ltd (acn 644 369 728) . By booking a tour with us you have agreed to be bound by the terms and conditions set out in:

the specific Tour Itinerary (as stated on our website) that you purchase;
Which constitutes the entire agreement between you and us. Your booking will be accepted by us on this basis. The services to be provided are those referred to on our website description of your tour found under Tour Itinerary.
1. Terms
1.1 these terms apply from the time you make a booking to attend one of our tours. if anything in this document differs from what you have been told by our people, this document will take precedence.
1.2 by placing your booking (payment) for our tours (online) you accept and agree to abide by these terms and conditions.
1.3 by providing your personal information to us, you agree to our Privacy Policy
1.4 we have not waived our rights if we do not enforce any right contained in these terms during a particular time frame.

(a) we may add to, change or remove any of the terms and conditions or other clauses within this document
(c) continued use of this website means that the user accepts the terms outlined in the document.
1.6 we must collect your personal information to deliver our the products or services that you purchase / book; our partners located in the destination we tour to also collects, uses and discloses only that information reasonably required to enable the tour; specifics on the products and/or services that you have requested as described our Privacy Policy; by submitting any personal information, you indicate your acceptance of our Privacy Policy.
2. Travel Arrangements
2.1 tours include the specified accommodation, meals, activities, transportation, as outlined in the Tour Itinerary sections of the website
2.2 tours do not include flights to / from tour destination, travel insurance, entry visas, additional meals, airport transfer (unless specified otherwise), any tips and porterages, or other travel costs outside of the specified. it is your responsibility to make arrangements and pay for any of the above required to travel to our tour locations.
2.3 it is your responsibility to ensure that you have a valid passport (with at least 6 months validity prior end of tour date), visa and re-entry permits which meet the requirements of the immigration and other government authorities in the tour locations (travel documents). by making a tour booking with us you warrant that you have all travel documents required to attend the tour. any fines, penalties, payments or expenditures incurred as a result of travel documents not meeting the requirements of those authorities will be your sole responsibility.
2.4 it is compulsory that you take out appropriate travel insurance for the duration of the trip and we will request policy details prior to departure.
2.5 you must familiarise yourself with any health requirements and recommended precautions relevant to your travel to our tours and ensure that you carry all necessary vaccination documentation. you should consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel to our trip destination.
2.6 while participating in any tour, images, photos or videos may be taken by us or our representatives that may contain or feature you; you consent to any such pictures being taken and grants a perpetual, royalty-free, worldwide, irrevocable license to us to reproduce for any purpose whatsoever, in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you;
3. Health and Fitness
3.1 you must be at least 18 years of age at the time of tour departure to participate in our tours.
3.2 upon each booking of a tour, and each time you attend one of our tours and participate in tour related activities, you warrant that:
(a) you are in good medical and physical condition; and
(b) there is no reason, medical or otherwise, why you should not undertake any physical activity outlined in the Tour Itinerary section of the tour you have purchased.
3.3 we reserve the right to refuse you from participation in an upcoming tour (that has not departed), from parts of a tour (that has departed), or related tour activities, without refund, if:
(a) we perceive a reasonable risk of injury to you or any other person due to your participation; or
(c) you do not adhere to Community Guidelines
3.4 by participating in any tour and any related tour activity you agree to the following:
(a) you’ll comply with directions and policies.
(b) you acknowledge that any type of activity / exercise involves risk of injury which may result in death or serious disability.
(c) despite such risk you agree that you participate entirely at your own risk of injury or bodily harm to yourself and others.
(d) you release us and all of our people and any other persons involved in my participation in any activity with us from any action, claim, suit or demand for compensation whether for damage to property or personal injury arising from your participation.
(e) you understand that these terms are contractual and may be relied upon in any proceedings by or involving you and your heirs, executors and assigns.
(f) to the fullest extent permitted by law, we make no warranties about the goods or services we supply. where you have the benefit of guarantees that cannot by law be excluded or varied, our liability for breach of any such guarantee is limited (at our option) to:
(i) re-supply of services;
(ii) payment of the cost of same.
3.5
(a) our people are not medically trained;
(b) our people are not qualified to assess if you are in good physical condition;
(c) our people are not qualified to assess if you are physically capable of any of the active or passive exercises without risking your health, safety or comfort.
(d) we strongly suggest you seek expert advice before participating in our tours
4. Liability
4.1 to the extent permitted by law, neither we nor any of our related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), travel delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part.
5. Payments
5.1 our current fees for our tours are available on our website. tour fees do not include airfares or other travel costs, insurance, taxes, tips or anything not outlined in Tour Itinerary under ‘inclusions’.
5.2 to secure your spot on all tours, you must pay a deposit. your deposit is considered non-refundable unless your tour has not been confirmed. any refund of the deposit over and above this is at the sole discretion of our company.
5.3 the remaining or final balance (tour fee minus deposit) is due no later than 60 days prior to the start date of the tour.
5.4 if you book 60 days or less prior to the start of the tour, you must pay full amount at time of the booking.
5.5 payment of final balance payment of fees for your tour is to be paid via bank transfer.
5.6 any payments of final balance paid via credit card will incur a surcharge of 2.9% (this is the merchant fee we are charged for the transaction)
5.7 fees for our tours are subject to availability and we reserve the right to withdraw or change our fees for a tour (for any tour not paid in full) and to change tour itineraries, at any time prior to tour commencing.
5.8 transfer of bookings to another individual not named on the original booking are not permitted.
5.9 if you book on behalf of another traveller, you:
a) are deemed the designated contact person for all participants on that booking; this means you are responsible for making all payments associated with booking and notifying us of any changes or cancellation required
b) represent and warrant that you have obtained all required consents; are responsible for verifying that any information you provide on behalf of another participant is complete and accurate; we are not liable for any errors or omissions in the information provided by you to us to complete a booking
c) are responsible for keeping your party informed of any communications from us
5.10 any special requirements must be disclosed to us at the time of booking; we will use reasonable efforts to accommodate special requirements or requests; certain activities may be inaccessible to you if your mobility is limited in any way; all food allergies and dietary restrictions must be disclosed to us at the time of booking; we will cannot guarantee that dietary needs or restrictions can be accommodated in all circumstances
6. Cancellations, postponements, refunds
6.1 tour with me does not offer refunds outside of those listed below. this is due to the prepaid nature that we must adhere to with our partners we work with in each destination and any pre booking fees, non refundable fees, they have incurred as part of the services included in the tour:
(a) your deposit is considered non-refundable unless your tour has not been confirmed; any refund of the deposit over and above this is at the sole discretion of our company.
(b) if you cancel up to 60 days or more prior to the tour, and the tour has not been confirmed, you can receive the full amount paid to date as a credit or a refund,
(c) if you cancel up to 60 days or more prior to the tour, and the tour has been confirmed, you can receive the full amount paid to date as a credit or a refund, with exclusion of the deposit.
(d) if you cancel 60 days or less prior to the tour, you will forfeit all payments made towards the tour; any refund over and above this is at the sole discretion of our company.
(e) if you cannot travel due to covid-19 border closures, you can receive a credit, with exclusion of the deposit.
(f) a credit for future tour with me travel will be provided to anyone who cannot attend the tour due to contracting Covid-19. travellers will need to provide evidence in the form of a positive pcr confirmation (i.e. text or email containing travellers name, phone number, date of test, location of test) taken within 48 hours of the trip in order to receive the credit. credit will be minus the deposit portion and unrecoverable costs. a rapid antigen test (rat test) is not currently accepted as evidence.
(g) travellers who have paid ‘in-full’ will be given scheduling priority vs. travellers who have paid with ‘deposit only’
6.2 exceptions to our policy cannot be made for any reason, this is why it is imperative to get travel insurance as soon as you have paid the deposit. please make sure that natural disasters and personal injuries are covered. we do not offer credit for arriving late or leaving early from tours.
6.3 all cancellations must be made in writing via email to hello@tourwithme.co; your deposit is considered non-refundable unless your tour has not been confirmed
6.4 tour with me may postpone or cancel a tour if a minimum quota of attendees has not been reached within 90 days tour date (i.e. tour has not been confirmed). minimum quota of travellers required to run a tour is dependent on each tour.
6.5 tour with me shall not be liable for any failures beyond its control. this covers natural disasters, war, ‘acts of god’, closure of airports, civil strife, accidents or failure to perform by third parties, including suppliers and subcontractors that cause a delay or cancellation of tour or its services. it is imperative to get travel insurance as soon as the tour is confirmed.
6.6 tour with me is not responsible for any expenses incurred in preparation for any cancelled trip, such as airline tickets, loss of work, and/or other costs associated with preparation for your tour. it is imperative to get travel insurance as soon as the tour is confirmed.
6.7 any refunds for deposits made via credit card will have a 2.9% merchant fee deducted
7. Community Guidelines
7.1 in order to ensure everyone has an enjoyable, inclusive, and safe tour, all tour participants agree to the following terms:
a) KNOW THE DETAILS - read the full itinerary, accommodation types, and specifics on the trips (style, rooming configuration, activities involved, etc.) prior to booking
b) BE AGILE - understand their will be last-minute changes to itinerary may occur, flights are delayed, and weather isn’t always great. travel plans always have ‘bumps’ from time to time, and more so in a post COVID world; TWM will communicate changes as they happen and we won’t let a little rain ruin our day; the itinerary is a guideline only, and the final call on itinerary changes rests with the TWM team.
c) UNDERSTAND YOUR COMFORT - tours usually involve a lot of walking and moving from location to location; this includes sleeping in beds that aren’t the ones you have at home, as well as weather and climate that is vastly different than what you are used to - don’t be discouraged, but do understand whether you are comfortable with the type of tour you are signing up for prior to booking
d) RESPECT YOUR GUIDE - your local guide has been provided to ensure you have a wonderful and informative tour according to the itinerary; any free time or extra curricular activities are up to travellers to organise; unless it’s an emergency, let the guide have some down time in between showing you the best the destination has to offer
e) BRING YOUR BEST SELF - be a kind and considerate person that treats others with respect and dignity; you are all on tour together for a reason - to share in your common passion! when in doubt, be someone that other people want to be around (i.e. don’t be someone you wouldn’t want to be around)
f) BE CURIOUS - bring an open and inclusive mindset to the people you meet and places you visit; your tour is an opportunity to step outside your comfort zone, try new and weird things; whilst differing views is encouraged; ensure to do so with consideration and empathy; always treat others with respect and and dignity; you will be travelling with people from all different backgrounds, countries, and cultures – use it as a chance to learn and grow
g) RESPECT OTHERS PRIVACY - be respectful of others digital privacy by not taking photos, sharing personal information, or anything deemed sensitive without first receiving their consent; remember that your tour is meant to relaxing and a source of enjoyment – not stress and anxiety
h) ACT SAFELY - stay safe and use common sense at all times; although you will be travelling to known locations with an experienced guide, it is still important to remember to mind your surroundings at all times
i) DON’T BE INAPPROPRIATE - no hate, bullying, sexist, racist, trolling, passive aggressive or perceivably inappropriate speech or actions will be tolerated (either on tour or via any communication mediums); if you think it’s something that will offend someone, you wouldn’t want directed to you, or would get you fired from a workplace or team – then keep it to yourself; anyone found to be promoting any negative speech or topics will face removal from TWM communication mediums and possible removal from the tour
j) FOCUS ON THE TOUR - we encourage organic conversation on work and business amongst travellers, but ask all travellers refrain from any advertising another business, sharing spam, or active self promotion; if you think it will be additive to the tour or experience, please let the TWM team know first
7.2 failure to adhere to the above requirements outlined above may result in removal from tour with me platforms - for current and future trips. tour with me reserves the right to take appropriate steps to prevent and stop any behaviors that are not inline with the above guidelines. by booking / purchasing a tour, you are in agreement with the guidelines listed above; we ask all travelers to report any behavior that violates our guidelines to hello@tourwithme.co
8. Governing law, severability and definitions
8.1 these terms are governed by the laws of New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
8.2 if any provision of these Booking Conditions is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable; the invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.
8.3 definitions to the above include:
a) activities - anything that the group of travellers take part in (classes, workshops and sessions) whether group or individual, alongside our our people.
b) confirmed (tour) - the minimum number of travellers required for the tour to proceed or occur has been met and has been communicated to travellers who have secured a spot on tour via email
c) our people - means any staff, tour guides, or contractors of working for or with tour with me.
d) personal information - means any information capable of identifying an individual including name, address, phone number and email address.
e) tours - means the activities and events organised by Tour With Me (TWM) at various locations; accommodations, meals, tour activities, itineraries, fees and payment arrangements, and availability will be in accordance with individual tour itinerary descriptions posted on our website and may be subject to change.
